These Terms of Service (“Terms”) govern your access to and use of powerexams.com and the certification and exam-preparation content and features offered there (the “Services”), provided by PowerExams (“PowerExams,” “we,” “us”). By creating an account, purchasing access, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Who may use the Services

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase access. By using the Services you represent that the information you provide is accurate and that you will keep your account credentials secure. You are responsible for all activity that occurs under your account.

What we provide

PowerExams offers original study guides, practice questions, timed practice exams, flashcards, study plans, analytics, and related tools to help you prepare for third-party certification and admissions exams. Access to premium content is granted on a time-limited basis according to the plan you purchase.

License and acceptable use

Subject to these Terms and your active plan, we grant you a personal, non-exclusive, non-transferable, revocable license to access the Services for your own exam preparation. You agree not to:

• Copy, reproduce, scrape, resell, sublicense, or publicly distribute our content;
• Share your account or license key with others, or use a single purchase to provide access to multiple people;
• Attempt to bypass paywalls, security, or usage limits, or reverse-engineer the Services;
• Use the Services to build a competing product or to train machine-learning models on our content;
• Use the Services for any unlawful purpose or in a way that harms PowerExams or other users.

We may suspend or terminate accounts that violate these Terms, without refund.

Intellectual property

All practice questions, passages, explanations, guides, and other materials on the Services are original works created by PowerExams and are protected by intellectual-property laws. No real, live, or retired exam items are reproduced. All rights not expressly granted to you are reserved by PowerExams.

Not affiliated; educational use only

PowerExams is an independent study resource. We are not affiliated with, authorized, or endorsed by ServiceNow, the Association of American Medical Colleges (AAMC), the North American Registry of Midwives (NARM), the Midwifery Education Accreditation Council, MANA, or any other certifying or testing organization. Names such as “ServiceNow,” “MCAT,” “NARM,” and “CPM” are used nominatively only to describe the exams our materials help you prepare for, and remain the property of their respective owners.

Our content is provided for educational and test-preparation purposes only. It is not professional, clinical, medical, legal, or financial advice, and it must not be relied upon as such. Nothing on the Services guarantees any particular exam score or outcome, except where a specific written guarantee is clearly stated for a particular plan at the time of purchase.

Payments and access

Purchases are processed by Creem, our merchant of record. Prices, access durations, and what each plan includes are described at checkout. Your access begins when your purchase is confirmed and continues for the duration of the plan you bought. Please review our Refund Policy, which forms part of these Terms.

Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that content is complete or perfectly accurate.

Limitation of liability

To the maximum extent permitted by law, PowerExams and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or opportunity, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim arose.

Indemnification

You agree to indemnify and hold harmless PowerExams and its operators from any claims, damages, or expenses arising out of your misuse of the Services or violation of these Terms.

Changes to the Services and these Terms

We may modify or discontinue features of the Services, and we may update these Terms from time to time. When we update the Terms we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the United States and the state in which the operator of PowerExams is based, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located there.
